genbee Terms & Conditions
These Terms govern access to genbee, including its AI tutoring, curriculum, learner profiles, subscriptions, credits, and related services (the “Service”). The Service is provided by Augme Technologies L.L.C. (“Augme,” “genbee,” “we,” “us,” or “our”).
1. Accepting these Terms
By creating an account, purchasing or activating a subscription, creating a learner profile, or using the Service, you agree to these Terms and our Privacy Policy. If you use genbee for an organization, you represent that you have authority to bind that organization. If you do not agree, do not use the Service.
2. Adult account holder and learner eligibility
The account holder must be an adult with authority to accept these Terms, create and manage learner profiles, supervise learner use, maintain account credentials, and make decisions about learner information. For the initial launch, learner profiles are limited to people aged 13 or older who may lawfully use the Service in their location. Do not create a profile for a child under 13.
An adult account holder may invite an eligible learner to link a Microsoft sign-in to one specific profile. The adult remains responsible for the family account and may revoke that learner’s access. genbee will not open under-13 access unless a compliant verified parental-consent process and related notices are available.
3. Educational service and AI limitations
genbee is an educational and informational service. AI-generated responses and illustrations can be incomplete, inaccurate, unavailable, or unsuitable for a learner. The account holder must provide age-appropriate supervision and independently check important information.
genbee is not a teacher of record, licensed professional, medical or mental-health provider, emergency or crisis service, or substitute for qualified advice. Do not rely on it for medical, legal, financial, mental-health, safety-critical, or emergency decisions. Automated safeguards may screen interactions for safety, but genbee does not promise continuous human monitoring or emergency intervention.
4. Subscriptions, credits, and Marketplace billing
The initial Microsoft Marketplace subscriptions are Starter, Plus, Pro, and Ultra. The plan page and Microsoft checkout show the current price, included credits, profile and concurrency limits, overage availability and price, renewal terms, and other plan rules. If those displays conflict, the terms shown by Microsoft at purchase control the Microsoft-billed transaction.
One credit pays for five minutes of active AI tutoring. Browsing the catalog and reading account reports do not count as active tutoring. Content bundles use the published credit amounts: a lesson starter bundle is four credits (one-credit permanent lesson unlock plus three tutor credits); a four-lesson mini-course is fourteen credits (two-credit permanent course unlock plus twelve tutor credits); and an eight-lesson course is twenty-six credits (two-credit permanent course unlock plus twenty-four tutor credits). Games, assessments, or other items use the amount displayed before confirmation. Content unlocks, games, and assessments require available wallet credits and never create automatic metered overage. Credit packs of 10, 25, 60, or 150 credits are billed by Microsoft through the Marketplace subscription at the price shown before confirmation; each pack size can be purchased once per subscription per hour, and pack credits are added to the account only after Microsoft accepts the charge. Unused included credits, purchased credits, content access, and refunds are subject to the rules displayed for that item and applicable law.
Microsoft manages Marketplace payment processing, taxes, invoices, subscription renewal, and cancellation. Augme manages product activation, entitlements, credit accounting, and product support. Subscription cancellation does not necessarily reverse prior charges or usage. Billing and monetary-refund rights are governed by the applicable Microsoft agreement and law; product-credit adjustments are handled under the rules shown in genbee.
5. Acceptable use
Use genbee only for lawful educational purposes. You must not:
- submit unnecessary sensitive personal information or another person’s information without authority;
- seek or distribute unlawful, exploitative, abusive, sexually explicit, violent, discriminatory, or dangerous content;
- evade safeguards, age controls, access restrictions, plan limits, or usage metering;
- interfere with, overload, scrape, probe, reverse engineer, resell, or misuse the Service; or
- use the Service to violate intellectual-property, privacy, publicity, or other rights.
6. Your content and feedback
You retain rights you hold in content submitted to the Service. You grant Augme a limited, worldwide license to host, process, transmit, reproduce, and adapt that content only as reasonably necessary to provide, secure, maintain, support, and improve the Service, comply with law, and enforce these Terms. You represent that you have the rights and permissions needed for submitted content. If you voluntarily provide feedback, Augme may use it without restriction or compensation.
7. genbee intellectual property
The Service, software, curriculum, designs, models, trademarks, and related materials are owned by Augme or its licensors and are protected by law. Subject to these Terms, Augme grants you a limited, non-exclusive, non-transferable, revocable right to use the Service for its intended educational purpose. No other rights are granted.
8. Account security, suspension, and termination
Keep credentials secure and notify us promptly about suspected unauthorized use. We may restrict or suspend access when reasonably necessary to protect learners, users, the Service, or third parties; address misuse or nonpayment; comply with law or Microsoft requirements; or investigate security or safety concerns. You may cancel through Microsoft Marketplace and use account controls to export or request deletion of account information.
9. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” AUGME DISCLAIMS IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION. THESE DISCLAIMERS DO NOT LIMIT RIGHTS THAT CANNOT LAWFULLY BE WAIVED.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AUGME AND ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS, DATA, GOODWILL, OR OPPORTUNITIES. AUGME’S TOTAL LIABILITY ARISING FROM THE SERVICE WILL NOT EXCEED THE AMOUNT PAID FOR THE SERVICE DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. THESE LIMITS DO NOT APPLY WHERE PROHIBITED BY LAW.
11. Changes
We may update the Service and these Terms. If a change is material, we will provide notice as required by law and update the effective date. Continued use after the revised Terms take effect constitutes acceptance where permitted by law.
12. Governing law and court-only disputes
These Terms are governed by Texas law, excluding its conflict-of-law rules. Except where applicable consumer law requires otherwise, any dispute arising from these Terms or the Service must be brought exclusively in the state or federal courts located in Dallas County, Texas. Each party consents to those courts’ jurisdiction and venue. These Terms do not require arbitration and do not waive any non-waivable right.
